[Chapter 1 General Provisions]
- Article 1 (Purpose)
- (1) These Terms of Use (hereinafter referred to as “Terms and Conditions”) are for the www.ivra.or.kr site jointly provided by the International Virus Research Alliance (hereinafter referred to as “International Virus Research Alliance”) to its users (hereinafter referred to as “members”). The purpose is to specifically stipulate all matters related to the subscription conditions and use of (hereinafter referred to as “Service”) and other necessary matters.
- Article 2 (Effectiveness and change of Terms of Use)
- (1) These terms and conditions take effect when they are announced on the service initial screen or notified to members by e-mail.
- (2) If reasonable grounds arise, the International Virus Research Alliance may revise these terms and conditions to the extent that the organization does not violate relevant laws and regulations.
- (3) When the International Virus Research Alliance revises these terms and conditions, it specifies the date of application and the reason for revision and announces them on the initial screen of the service along with the current terms and conditions from 7 days prior to the date of application until the day before the date of application.
- (4) When revising the terms and conditions, the revised terms and conditions will only apply to contracts concluded after the date of application, and the terms and conditions before revision will remain applicable to contracts already concluded before that date. However, only if a user who has already entered into a contract wishes to be subject to the provisions of the revised terms and conditions has been sent to the International Virus Research Alliance within the notice period of the revised terms and conditions under paragraph 3 while the consent of the International Virus Research Alliance has been obtained, the revised terms and conditions shall only be provided.
- (5) If a member does not agree to the changed terms and conditions, he or she may request withdrawal (cancellation) of membership. If he or she continues to use the service after the effective date of the changed terms and conditions, he or she will be deemed to have agreed to the changes in the terms and conditions.
- Article 3 (Rules other than terms and conditions)
- Matters not specified in these Terms and Conditions shall be governed by the purpose of the Terms and Conditions for each service, the Framework Act on Telecommunications, the Telecommunications Business Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Youth Protection Act and other relevant laws and regulations of the Republic of Korea.
- Article 4 (Definition of Terms)
- (1) ‘Member’ refers to a person who regularly donates a certain amount to the International Virus Research Alliance in order to receive services, or prepares and submits a separate membership application in writing and receives approval.
- (2) ‘Non-member’ refers to a person who uses the service without entering into a membership contract (submission and approval of a membership application or regular sponsorship of a certain amount) with the International Virus Research Alliance.
- (3) ‘User’ refers to members and non-members who access the website and use the service in accordance with these Terms and Conditions.
- (4) ‘Use Agreement’ refers to submitting an application for membership or donating a certain amount on a regular basis while agreeing to the terms and conditions of the International Virus Research Alliance.
- (5) ‘Cancellation’ means that the International Virus Research Alliance or a regular member discontinues sponsorship, or a member who fills out a written membership application separately communicates his/her intention to cancel by phone or in writing.
[Chapter 2 Conclusion of Service Use Agreement]
- Article 5 (Establishment of Service Use Agreement)
- (1) The service agreement is established when the customer agrees to the terms of use and regularly donates a certain amount or completes and submits a membership application and the International Virus Research Alliance approves the membership.
- (2) It is presumed that the customer is agreeing to these Terms of Use when using the service.
- Article 6 (Application for service use)
- (1) Customers who wish to sign up as members and use this service must provide the information (name, contact information, etc.) requested by the International Virus Research Alliance. However, information provided by members is managed in accordance with the privacy policy.
- (2) All members must provide their own name to use the service, and users who do not register with their real name cannot claim any rights.
- (3) The International Virus Research Alliance may differentiate the use of members who use this service by subdividing the usage time, number of uses, service menu, etc.
- Article 7 (Protection and Use of Personal Information)
- (1) The International Virus Research Alliance strives to protect users’ personal information, including member registration information, in accordance with relevant laws and regulations. The protection and use of user personal information is subject to relevant laws and the International Virus Research Alliance's personal information handling policy.
However, sites linked on the service page are subject to the privacy policy of the linked site operator, not the International Virus Research Alliance. Additionally, the International Virus Research Alliance is not responsible for any information exposed due to reasons attributable to the user. - Article 8 (Approval and Restrictions on Application for Use)
- (1) The International Virus Research Alliance, in principle, approves the use of the service in the order of application for customers who apply for use pursuant to the provisions of Article 6 if there is no problem in business performance or technology.
- (2) The International Virus Research Alliance does not accept cases that fall under the following conditions.
- If your name is not your real name or you applied using someone else’s name
- If the contents of the service agreement application form are falsely entered
- If you wish to use this service for the purpose of committing a crime prescribed by criminal law
- If you wish to use this service for purposes that violate the purpose of the Youth Protection Act
- If you wish to use this service for purposes that violate other current laws and regulations
- If you wish to use this service for profit-making purposes
- When a user in competition with this service applies for the purpose of harming the interests of the International Virus Research Alliance.
- If an application is made in violation of other provisions - (3) If an application for service use falls under any of the following items, the International Virus Research Alliance may withhold approval of the application until the reasons for the restriction of approval are resolved.
- When the International Virus Research Alliance does not have sufficient facilities
- In case of technical difficulties of the International Virus Research Alliance
- In cases where it is difficult to approve use due to the circumstances of the International Virus Research Alliance - (4) If the customer applying for use is a child under the age of 14, the International Virus Research Alliance may withhold approval without the consent of a legal representative in accordance with the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.
[Chapter 3 Obligations of Contracting Parties]
- Article 9 (Obligations of the International Virus Research Alliance)
- (1) The International Virus Research Alliance must ensure that customers can use the service on the desired service start date unless there are special circumstances.
- (2) In order to provide continuous and stable services, the International Virus Research Alliance must repair or restore the equipment without delay unless there are unavoidable reasons.
- (3) The International Virus Research Alliance must announce and comply with its personal information handling policy to protect personal information.
- (4) If opinions or complaints raised by users are objectively recognized as legitimate, the International Virus Research Alliance must immediately process them through appropriate procedures. However, if immediate processing is difficult, the reason and processing schedule must be notified to the customer.
- Article 10 (Obligations of members, etc.)
- (1) When applying for membership or changing member information, members must fill out all information in their real name and based on facts. If it is discovered that you have used false or someone else's information, you cannot claim any rights related to using the service.
- (2) Members must comply with the matters stipulated in these Terms and Conditions, all other regulations established by the International Virus Research Alliance, and matters announced by the International Association for Virology Research. Additionally, members must not engage in any actions that interfere with the work of the International Virus Research Alliance or damage the reputation of the International Virus Research Alliance.
- (3) Members must comply with relevant laws such as the Youth Protection Act. If a member violates relevant laws, such as the Youth Protection Act, he or she will be punished in accordance with the relevant laws.
- (4) If there are changes to the terms of the service agreement, such as address, contact information, or e-mail address, members must modify them online. Members are responsible for any problems arising from failure to make corrections or delays in corrections.
- (5) Members may not engage in business activities using the service without prior approval from the International Virus Research Alliance, and members are responsible for the results of such business activities. In addition, if a member causes damage to the International Virus Research Alliance through such business activities, the member has an obligation to compensate the International Virus Research Alliance, and the International Virus Research Alliance will restrict the member's use of the service and compensate the member for damages through legal procedures. etc. may be charged.
- (6) Members must not infringe on the intellectual property rights of the International Virus Research Alliance and third parties.
- (7) In order for a child under the age of 14 to sign up for membership, except in special cases, the child's legal representative must agree to the child's sign up for membership.
- (8) Members must not engage in any of the following acts, and if they do so, sanctions may be imposed, including restrictions on service use by members of the International Virus Research Alliance and legal action.
- Registering false information when applying for membership or changing member information
- Impersonating a member of the International Virus Research Alliance management, staff, or officials
- Modify the program of the International Virus Research Alliance, hack the server of the International Virus Research Alliance, arbitrarily change part or all of the website or posted information, or modify the International Virus Research Alliance's programs without receiving special rights from the International Virus Research Alliance. Using the service in an abnormal way
- Exploiting bugs in the International Virus Research Alliance program
- Acts that cause harm to the service or intentionally interfere with the service
- Conducting business activities using the service without prior approval from the International Virus Research Alliance.
- Reproducing information obtained through this service for purposes other than using the service, using it in publications or broadcasts, or providing it to a third party without prior consent from the International Virus Research Alliance.
- Content that infringes on others’ patents, trademarks, trade secrets, copyrights, and other intellectual property rights. Disseminating to others by transmitting, posting, e-mail, or other means
- Distributing to others by transmitting, posting, e-mail or other means any vulgar or obscene information, sentences, shapes, sounds or videos that violate the Youth Protection Act or the Criminal Act.
- An act of distributing to others by transmitting, posting, e-mailing or otherwise using content that is severely insulting or personal and may infringe upon the honor or privacy of others.
- Harassing or threatening other members, or continuously causing pain to specific members. or acts that cause inconvenience
- Collecting or storing personal information of other users without approval from the International Virus Research Alliance.
- An act that is objectively judged to be linked to a crime
- Acts that violate these terms and conditions or other regulations or terms of use established by the International Virus Research Alliance
- Acts that violate other relevant laws and regulations
[Chapter 4 Service Use]
- Article 11 (Service usage time)
- (1) Service use is operated 24 hours a day, 365 days a year, unless there are special business or technical problems. However, the International Virus Research Alliance may temporarily suspend the service on days or times set by the International Virus Research Alliance for regular system inspection, expansion, and replacement. Temporary suspension of service due to scheduled work may be announced in advance through the service page.
- (2) The International Virus Research Alliance may temporarily suspend services without notice due to unavoidable reasons such as urgent system inspection, expansion and replacement, and the current service may be suspended for reasons deemed appropriate by the International Virus Research Alliance, such as replacement with a new service. We may completely discontinue the services provided.
- (3) The International Virus Research Alliance may restrict or suspend all or part of the service if it is impossible to provide normal service due to a national emergency, power outage, service facility failure, or surge in service use. However, in this case, the reason and period will be notified to the member in advance or after the fact.
- (4) The International Virus Research Alliance may divide the service into specific ranges and separately designate available times for each range. However, in this case, the details will be notified.
- Article 12 (Copyright to website)
- (1) All materials provided on this site are works protected by copyright law, and unauthorized copying and distribution is prohibited in principle. Unauthorized reproduction or distribution may result in infringement of rights under Article 136 of the Copyright Act, illegal publication under Article 137, and violation of source disclosure under Article 138 of the Copyright Act.
- (2) In order to use the materials provided on this site for purposes other than simple sharing, you must consult with or obtain permission from the International Virus Research Alliance in advance.
- (3) Even when materials from this site are posted on other Internet sites in accordance with legal procedures, unauthorized modification of the content is prohibited, and any violation may be subject to criminal punishment under Article 136 of the Copyright Act.
- Article 13 (Provision of information)
- (1) Various information deemed necessary for members of the International Virus Research Alliance to use the service may be provided to members through the service screen, e-mail, or postal mail.
- (2) The International Virus Research Alliance may request additional personal information with member consent for the purpose of improving services and introducing services to members.
- Article 14 (Restrictions on Service Use)
- (1) If a member of the International Virus Research Alliance violates Article 11 of these Terms and Conditions in the use of the service or falls under any of the following, the use of the service may be restricted without prior notice.
- If you severely insult other members or interfere with their use of the service.
- In case of harm or intentional interference with the service
- If it interferes with other normal service operations
- When transmitting or posting information prohibited by relevant laws such as the Youth Protection Act
- When there is a request for correction from related public institutions such as the Information and Communication Ethics Committee
- In case of violation of all regulations or terms of use established by the International Virus Research Alliance, including these Terms and Conditions
- If you commit an act that violates other relevant laws and regulations - Article 15 (Delete of Service and Separation of Site)
- (1) In order to provide high-quality services, the International Virus Research Alliance may modify or delete the service at any time according to the needs of the International Virus Research Alliance. We will notify members in advance of any matters that may result in serious disadvantages to members due to such modifications or deletions.
- (2) The International Virus Research Alliance may reorganize or separate the site. In this case, the International Virus Research Alliance notifies members in advance about the specific method of use.
[Chapter 5 Contract Termination]
- Article 16 (Contract change and termination)
- (1) When a member wishes to terminate the service agreement, the member must convey his or her intention to cancel in writing.
- (2) In the case of members, if they wish to discontinue sponsorship separately from canceling their membership on the site, they must express their intention to discontinue through the site or via phone. However, if a member wishes to terminate the site use contract, the registered personal information will be destroyed.
- (3) The International Virus Research Alliance may terminate the service agreement without prior notice if a member violates Article 11 of these Terms and Conditions in terms of service use, or if any of the following applies.
- If you severely insult other members or interfere with their use of the service.
- In case of harm or intentional interference with the service
- If it interferes with other normal service operations
- When transmitting or posting information prohibited by the Youth Protection Act
- When there is a request for correction from related public institutions such as the Information and Communication Ethics Committee
- In case of violation of all regulations or terms of use established by the International Virus Research Alliance, including these Terms and Conditions
- If you commit an act that violates other relevant laws and regulations
[Chapter 6 Dispute Mediation and Other Matters]
- Article 17 Compensation for damages
- (1) The International Virus Research Alliance is not responsible for any damage incurred by members in connection with the use of free services provided by the International Virus Research Association.
- (2) When the International Virus Research Alliance enters into a partnership agreement with an individual service provider and provides individual services to members, if damage occurs due to reasons attributable to the individual service provider after the member agrees to the individual service terms and conditions, the related damages will be covered. The individual service provider is responsible for this.
- Article 18 Disclaimer
- (1) If the International Virus Research Alliance is unable to provide services due to natural disasters, war, or other force majeure, it is exempt from liability for service provision.
- (2) The International Virus Research Alliance is exempt from liability if damage occurs due to a telecommunication service provider suspending or not providing telecommunication services properly.
- (3) The International Virus Research Alliance is exempt from liability for damages caused by unavoidable reasons such as repair, replacement, regular inspection, or construction of service facilities.
- (4) The International Virus Research Alliance is not responsible for any disruption or damage to the use of the service due to reasons attributable to members.
- (5) The International Virus Research Alliance is not responsible for damage caused by a user's computer error, or if damage occurs due to a member's incorrect personal information and e-mail address.
- (6) Unless there is intent or gross negligence, the International Virus Research Alliance is not responsible for any damage caused by data obtained by members while using the service. Additionally, the International Virus Research Alliance is not responsible for compensating members for any psychological damage suffered by other members while using the service.
- (7) The International Virus Research Alliance is not responsible for the reliability, accuracy, etc. of various information, data, and facts posted by members on the service.
- (8) The International Virus Research Alliance has no obligation to intervene in disputes that arise between users or between users and third parties through the service, and is not responsible for compensating for damages resulting therefrom.
- (9) The International Virus Research Alliance is not responsible for any damages arising from the use of services provided free of charge to members.
- Article 19 (Jurisdiction and Governing Law)
- (1) If matters not specified in these Terms and Conditions are stipulated in relevant laws and regulations, such regulations shall apply.
- (2) If a lawsuit is filed regarding a dispute arising from the use of the service, the competent court shall be the court in accordance with the procedures prescribed by law.
- Article 20 (Use of donations)
- (1) Donations will be used through the International Virus Research Alliance to help people in hardship or suffering from natural disasters, man-made disasters, or armed conflicts, regardless of race, religion, or political beliefs.
- Supplementary provisions
- (1) (Enforcement date) These terms and conditions will apply from August 1, 2024.
